{"id":313,"date":"2018-05-03T16:35:24","date_gmt":"2018-05-03T16:35:24","guid":{"rendered":"http:\/\/crimesofthecenturies.com\/?p=313"},"modified":"2025-07-15T15:37:04","modified_gmt":"2025-07-15T14:37:04","slug":"wicked-jimmy-westmorland-militia","status":"publish","type":"post","link":"https:\/\/crimesofthecenturies.com\/index.php\/2018\/05\/03\/wicked-jimmy-westmorland-militia\/","title":{"rendered":"Wicked Jimmy and the Westmorland Militia"},"content":{"rendered":"<p>If the militia in the late 1700s were <a href=\"https:\/\/crimesofthecenturies.com\/index.php\/2018\/04\/26\/american-invasion-britain\/\">akin to Dad\u2019s Army<\/a>, the commander of the Westmorland Militia was\u2026 well, he was Wicked Jimmy.<\/p>\n<p>Most families have a black sheep somewhere down the centuries, but the term doesn\u2019t seem quite enough to describe James Lowther, the first Earl of Lonsdale. Known as Wicked Jimmy after his death, I suspect he had a few nicknames privately while he was alive. Corrupt, heartless, merciless, a bully\u2026 A talk reported in the Cumberland &amp; Westmorland Herald in 2013<span class=\"Apple-converted-space\">\u00a0<\/span>gives a flavour of the man.<\/p>\n<p>Hands up, his attempted land grab of Inglewood Forest in the 1760s (from the Duke of Portland) seems to have forced one of my ancestors to give up a farm the family had occupied for generations. For in 1765, Wicked Jimmy served 400 freeholders in Penrith and Inglewood Forest with writs of ejectment. And it was between 1765 and 1768 that my ancestor moved to Torpenhow.<\/p>\n<p>However, in the interests of fair play, the following is presented as impartially as possible!<\/p>\n<h2>Perculation and oppression<\/h2>\n<p><strong>House of Commons, Monday, May 5, 1783<\/strong><\/p>\n<p>Lord Maitland presented a petition, signed by four officers of the Westmorland Militia, complaining that the regiment\u2019s commander, Sir James Lowther, had been guilty of \u2018great peculation and oppression\u2019.<\/p>\n<p>\u2018Peculation\u2019 was embezzlement of public property.<\/p>\n<p>Daniel Parker Coke (MP for Derby) seconded the motion.<\/p>\n<p>General Conway outlined the history of the matter, saying it had begun in July 1781, when charges had been made against the baronet. Some of his accusers hadn\u2019t been \u2018of the military profession\u2019 and therefore might not be thought the most proper prosecutors for a military offence.<\/p>\n<p>The charges were:<\/p>\n<ul>\n<li>that the honourable gentleman had given false certificates of the raising of some companies in his regiment;<\/li>\n<li>that he afterwards supported them by false musters and false returns;<\/li>\n<li>that drawing on the agents for full companies, he converted great sums of money to his own use;<\/li>\n<li>that the regiment was in rags;<\/li>\n<li>that their arms were unserviceable.<\/li>\n<\/ul>\n<p>General Henry Seymour Conway had investigated, and a board of general officers, who didn\u2019t think there was sufficient grounds for a court-martial.<\/p>\n<p>The general thought the charge of false musters was groundless, as the regiment was complete on inspection.<\/p>\n<p>Their clothing was finer than that of any other regiment, the lining finer by much than ordinary, and the buttons very handsome.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>The idea of the baronet pocketing money was laughable, given the unpaid bills were for small sums.<\/p>\n<p>As to the arms, the baronet had applied for new ones.<\/p>\n<h2>Wicked Jimmy&#8217;s response<\/h2>\n<p>Sir James\u2019 defence was delightful!<\/p>\n<p>He said one of his accusers \u2013 a Whitehaven apothecary called Jackson \u2013 had no connection with Westmorland and was a man of no property.<\/p>\n<p>He, on the other hand, was \u2018the owner of land, fire and water\u2019, in a town that had grown under the \u2018fostering care\u2019 of his family.<\/p>\n<p>He said he had paid Mr Rice the music master \u00a3300 to teach his regimental band to play. And dwelt much on the poverty of some of his accusers, seeming to infer that made them likely to be lying.<\/p>\n<p>SIr Charles Turner intervened here, saying he would not put up with such accusastions against the poor. The House of Commons was the best place the poor could seek justice against the rich and powerful, and he would ever lean in their favour.<\/p>\n<p>Charles James Fox said Lord Maitland\u2019s intentions (in presenting the petition) were most patriotic, but the House wasn\u2019t the place for such petitions. He was also satisfied with the baronet\u2019s defence.<\/p>\n<p>In the end, the House decided not to bring up the petition.<\/p>\n<h2>Besmirching the opposition<\/h2>\n<p>In early April 1783, one <strong>Captain Ralph Gowland<\/strong> of the Westmorland Militia distributed hand bills trying to prejudice the character of <strong>Robertson Lidderdale<\/strong>. Lidderdale paid for a notice in the Cumberland Pacquet, saying he was a party to the petition to Parliament about the regiment. He expressed his contempt for Gowland, hinting at behaviour that made it &#8216;impossible to consider him a gentleman&#8217;.<\/p>\n<p>Lidderdale signed off \u2018formerly Cornet in the Greys, and late Captain-Lieutenant in the Westmorland\u2019.<\/p>\n<p>Lidderdale had resigned his commission in the militia in August 1782, along with a <strong>Captain Robertson<\/strong>, and <strong>Lieutenants Jackson, Gill<\/strong>, and <strong>Dunn<\/strong>. Was Lt Jackson the \u2018man of no property\u2019 Lowther disparaged?<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>Newspapers of the time went into a little more detail. Lowther admitted the regiment had been short of numbers. But he claimed that Jackson\u2019s motive was political.<span class=\"Apple-converted-space\">\u00a0<\/span><\/p>\n<p>Of the other petitioners, he claimed <strong>Harrison<\/strong> had quarrelled with regiments and employers.<\/p>\n<p><strong>Gill<\/strong> was \u2018an insignificant person of around \u00a320 a year, who\u2019d left the regiment because he was slovenly and given to drinking&#8217;.<\/p>\n<p><strong>Thompson<\/strong> was of little repute and motivated by \u2018spleen\u2019: Lowther was prosecuting a relation of his, on a fraud allegation.<\/p>\n<p>And <strong>Lidderdale<\/strong> had \u201cquit the regiment in disgust because he wasn\u2019t allowed to keep a dirty little whore in the same house as the Lady of the Lieutenant Colonel\u201d.<\/p>\n<p>Sir Charles Turner said it was wrong of Lowther to vilify the petitioners.
